We at Joynup, Inc. (“Joynup,” “us,” “our” or “we”) are committed to protecting your privacy. This Privacy Policy describes the information we collect from you or that you may provide when you visit https://joynup.com/ and its affiliated links (the “Site”), and when you interact with us through the Site, whether online, mobile, or through a third-party website link, as well as our practices for collecting, using, maintaining, protecting, and disclosing that information. 

By using Joynup, including but not limited to, by using our Site, platform, software, products, customer service, engaging with us on social media, interacting with us in any way, or utilizing any of our services (collectively, the “Services”), you understand that we will collect and use your personal information as described in this Privacy Notice and you agree to this Privacy Policy. If you do not agree with our policies and practices, then you should stop using the Services. We may update this Privacy Policy from time to time. Your continued use of the Site after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

Our Privacy Policy applies to Personal Information (defined below) collected through our Services. This Privacy Policy does not apply to third party services, websites, or applications that we may link to through the Site. Children Under the Age of 18

Our Website is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Website. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the Site or on or through any of its Services, register on the Site, use any of the Services, interactive or public comment features of the Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 18, we will delete that information. Information Collection and Use

We collect several types of personal Information on our site. “Personal Information” uniquely identifies an individual or can identify an individual by combining it with other data. We collect Personal Information in a variety of ways, including but not limited to when you register for an Joynup account, when you use certain Joynup products or services, when you visit the Site, and when you enter promotions, contests or sweepstakes, or when otherwise using the Services. If you participate in a survey, promotion, contest or sweepstakes, we will collect information needed for you to participate (such as contact information), and to fulfill your prize. If you provide information about other users that allows you to send information to another person, or invite them to participate in the Services, we will collect, at a minimum, the recipient’s name and email address.

Personal Information collected by us may include your name, email address, postal address, birth date, marital status, anniversary date, interests, lifestyle information, familial information, hobbies, doctors, service providers, contacts, financial information, photos, documents, audio, video or text you submit, your profile, general usage metrics of the Services, email communication history with us, anything you submit to or post on the Site, and other information associated with you as well as other information that may or may not specifically identify you, as well as communications with your partners. While the information within these classifications may be required for the use of specific Services or features of the Site, you are not required to use all of the Services. The information collected through the Services may be stored at servers, computers, or other media located inside or outside the United States.

We may obtain information about you from third-party sources, such as Google, or other users, when applicable. This information may be utilized, analyzed, and/or compared with information that we have collected from you or that you have submitted to the Services. If we obtain information from third-party sources, you agree that your sole legal remedy for any harm associated with that information is against the third-party that provided the information to us, and that you will not assert any cause of action, claim or demand against us other than requesting we delete any erroneous information.

We collect anonymous and/or aggregated data across various products and services provided that no individual natural person can be identified from such data (“Aggregate Data”). The Aggregate Data will be used for various purposes, including without limitation to analyze behavior, trends, and Site interaction, and to improve and enhance our Services and for other development, creation of new features, diagnostic and corrective purposes in connection with our Services. We shall own all right, title and interest in and to the Aggregate Data and this is not considered personal data.

For each visitor to our Site, we may use various technologies, including but not limited to “cookies” and web beacons, to automatically gather certain information pursuant to your use of the Site, from your electronic device about your activities using the Site. Our Site uses "cookies" to help personalize your online experience. A cookie is a text file that is placed on your device by a web server. • communicating with you by e-mail, postal mail, telephone, text message, and/or mobile devices about products or services that may be of interest to you from Joynup, any affiliates, sponsors or other third-parties;
• enforcing this Privacy Policy, other Joynup posted policies, or otherwise manage its business;
• notifying you about changes to our Site, our Services, this Privacy Policy or other Joynup posted policies;
• where we have another legitimate interest in doing so;

• performing functions as otherwise described to you at the time of collection.

In order to perform certain services on your behalf, we may publish certain information that you provide. You agree that any testimonial feedback, stories, posts, interactions or other comments provided by you to Joynup through any form of communication including but not limited to through the Site and social media platforms, becomes the sole and exclusive property of Joynup and that such information may be used for any legally permissible purpose, including, but not limited to marketing and advertising our Services.

You acknowledge and agree that, unless otherwise prohibited by law, Joynup may use and disclose your personal and non-personal information to public or private third-parties: (i) for inspection by law enforcement officials (including in the case of potential criminal activity); (ii) to respond to cease and desist letters, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, any court orders; (iii) to enforce or apply the terms of this Privacy Policy or any other agreement between us; and (iv) to protect the rights, property and safety of our employees, contractors, users and other third parties, whether during or after the term of your use of our Services.

In addition, we may share aggregate and sell, non-individual information, incapable of identifying a particular person, with third parties for any lawful purposes.

California Residents

We will not share any personal information about you with other companies if prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law.

If you are a California resident, you may have certain rights with respect to your Personal Information including the following:

• the right to know, by way of our Privacy Policy and any specific inquiries you direct to us, where personal information we have about you comes from, what we use that information for, whether it is being disclosed or sold, and to whom it is being disclosed or sold;

• the right to receive equal service and pricing from Joynup even if you exercise any of your privacy rights.

Please be aware that such a request does not ensure complete or comprehensive removal of your content or information and that there may be circumstances in which the law does not require or allow removal even if requested. For example, if your Personal Information is contained in a quiz answer, quiz overview or agreement created by another user, only that user can delete that information.

Your Ability to Edit Your Account Information and Preferences

Joynup gives you the ability to edit your account information and preferences at any time, including changing your name, phone number, address, password, email, subscription, or whether you want Joynup to contact you about special promotions and new products. You may request we correct or delete any Personal Information that you have provided to us. We may not be able to delete your Personal Information except by also deleting your user account.

If you do not wish to receive promotional emails or other marketing communications from us, please let us know by clicking “Unsubscribe” at the bottom of one of our emails or by contacting us as provided below. Although you can opt not to receive promotional messages, we reserve the right to send you informational email messages about any user account you establish on our Site, or notices regarding the Site, as permitted.

To help us process your request, please include sufficient information for us to identify you in our records, including the email address used as your account login. We may need to verify your identity before providing you with Personal Information or updating it in our system. 

Security and Retention of your Personal Information

Your Joynup Account Information is password protected for your privacy and security. You are responsible for safeguarding and preventing unauthorized access to the user information and password that you use to access our Services. You agree not to disclose your password to any third party and you are responsible for any activity using your account, whether or not you authorized that activity. Please immediately notify us of any unauthorized use of your account.

We use industry standard security measures to secure your personal information from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to, through or on other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol. We regularly review our security measures to consider appropriate new technology and methods. 

We follow generally accepted industry standards to protect the Personal Information submitted to us, and to protect it from unauthorized access, use, modification or disclosure. Because of the sensitivity of information stored on Joynup, in addition to SSL encryption, we use Transparent Data Encryption and Redaction to protect data during storage and access inside of our database. Please be aware that the transmission of information via the internet is not completely secure. While we use commercially-reasonable methods to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. Therefore, although we take reasonable steps to secure your information, we cannot and do not promise or warrant that your information will always remain secure. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

We retain your Personal Information for the length of time needed to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Transfer of Your Personal Information

The Personal Information of yours that we collect through the Services may be stored and processed at servers, computers, or other media located at remote hosting locations or at the Company’s offices, which may not be in your home state or country, thus, your Personal Information may be transferred to a location outside of your jurisdiction. By accepting this Privacy Policy, you agree to the transfer of your Personal Information. We will use industry standard security measures and all necessary steps to keep your Personal Information private while in transit. 

External Links and Third-Party Privacy Practices

Joynup cannot guarantee or verify the contents of any externally linked website. You should therefore note you click on external links at your own risk and Joynup cannot be held liable for any damages or implications caused by visiting any external links. This Privacy Policy does not cover any third party’s use or handling of your information once it is shared. Instead, the privacy policy of the third-party will govern. We encourage you to visit the websites of those third-parties and fully read and understand their privacy policies. Some of these entities will have different privacy terms than we do and their servers may be located outside the United States.

The Services may link to other websites or through advertisements. We disclaim any and all responsibility for the privacy practices of third-parties that may have links to or from our Services. We encourage you to review the privacy policies and privacy statements of every website that you visit that collects personally identifiable information. 

Any payment transactions will be encrypted using SSL technology through our third party payment processor. Joynup uses Stripe to support our subscription payment functionality. Changes to this Privacy Policy

We may change the provisions of this Privacy Policy at any time, and will always post the latest version on our website. We may provide notice by email to you at the last email address you provided us, by posting notice of such changes on our sites and applications, or by other means consistent with applicable law. When changes are made to this Privacy Policy, we will revise the “last updated” date at the bottom of this Privacy Policy. Your continued use of our Site or Services after we have posted any policy changes indicates your agreement to the changes unless you notify us otherwise.
